Federal Court Mandates Release of Abrego Garcia from ICE Custody
A court has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement is without lawful basis.
"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge stated in her ruling.
The situation stems from a erroneous removal to El Salvador in March, which US authorities later admitted was an error. Following his return to the United States to face alien smuggling allegations, he was detained in federal custody.
In her order, the judge noted that the authorities does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
